A FAIRFAX executive who complained of chest pains before being breath tested by police on two separate occasions has been found guilty of drink driving.
Antony Catalano, who heads the media company’s real estate operations, had his licence cancelled for 16 months and was fined $500 by Magistrate Paul Smith this afternoon.
He will appeal the conviction.
Mr Catalano returned a blood-alcohol reading of 0.08 after he delayed three previous breath analysis attempts at Rosebud police station on March 10, 2014.
The decision, handed down at Frankston Magistrates’ Court, came after his lawyer Peter Billings unsuccessfully argued the informant, Senior Constable Adam Devlin, was not empowered to repeatedly test his client.
Earlier the court heard Mr Catalano was stumbling, uncooperative and smelled of alcohol while being breath-tested by police at 2.45am on that day.
